The Centre has formally set up the Mediation Council of India, bringing into effect an important institutional provision under the Mediation Act, 2023.
The Department of Legal Affairs under the Ministry of Law and Justice issued a notification on August 28 announcing the establishment of the statutory body under Section 31(1) of the Act. The notification was also published in the Gazette of India, Extraordinary.
The newly constituted body will be known as the Mediation Council of India and will have its head office in Delhi.
The Mediation Act, 2023 provides for the Council as a central statutory body to support and oversee the mediation framework introduced under the legislation. With the latest notification, this provision has now formally come into effect.
However, the notification does not mention the names of the Council’s members or office-bearers. It also does not clarify when the body will begin its regular functioning or provide details about the procedures that will govern its operations.
Further information regarding the Council’s composition, appointments and functioning is expected to be announced through separate government notifications or official documents in the future.
